Hyderabad, Sept 26 (Munsif News): Telangana is the only state in the country were its caretaker government has summoned the Legislative Council Session without Assembly. The Governor of Telangana E.S.L. Narismhan has already summoned the 10 th Council Session on September 27 at 11.00 am.
It may be recalled that the ruling TRS government headed by the Chief Minister K.Chandrasekhar Rao has dissolved the Assembly on September 6 with the intention of going for early polls. Usually, Legislative Council meetings are not held in the absence of a Legislative Assembly, in fact, the Council has no powers to take any decisions particularly with regard to Financial matter or policy matter it only approves the Bills which are passed by the Legislative Assembly, Even though any Bill introduced and passed in Council, it is compulsory that the Assembly has to pass, this means that Council has no powers to take any decision like a Legislative Assembly has.
According to the Constitutional experts, Legislative Assemblies and the Lok Sabha have to meet once in six months, if a state assembly does not meet once in six months, President Rule can be imposed. But in the Legislative Council there is no such condition and nothing will happen if the Council does not meet within 6 months.
The controversy which has arised is that the Caretaker Chief Minister K.Chandrasekhar Rao has dissolved the Assembly on September 6, without summoning the Legialative Assembly, the rules and procedure say that Assembly has to meet atleast once in 6 months, if this limit is crossed, President rule can be imposed. In the case of Telangana Legislative Assembly it has to meet before September 28, as its last sitting was on March 29, this year. As the Legislative Assembly was dissolved, the question of holding the Assembly session before September 28 does not arise.
The source said that the Business Advisory Committee will meet on the first day of Council meet and will decide the number of days the session will last. (Munsif News)
